In the United States, a judicial scandal is shaking the New York Bar. Michael Fourte, an experienced lawyer, was sanctioned by the U.S. Supreme Court for incorporating fictitious legal citations, generated by artificial intelligence, into his pleadings. Even more surprising, Fourte repeated the offense by using the same method to defend himself in court, causing an uproar in the legal community.

A Routine Case with Unexpected Consequences

The case began with a family dispute over an unpaid loan. During the presentation of his brief, Michael Fourte, the defense attorney, surprised his opponents by citing inaccurate legal references. These citations, labeled as “hallucinated” by the judge, appeared to come directly from an unverified AI tool.

According to the judge, several of the cases Fourte mentioned were entirely fictitious, while others were irrelevant to the arguments presented.

Following these irregularities, a motion for sanctions was filed. During the disciplinary hearing, Fourte worsened his case by again using AI to support his defense. Seven of the cases he cited did not exist, and three others were irrelevant. When questioned about these errors, Fourte attempted to justify himself, explaining that some passages, though in quotation marks, were merely unintentional paraphrases.

Ultimately, he admitted his fault, stating, “I don’t really have any excuses.”

A Heavy Sanction and a Warning to the Profession

The Supreme Court did not take the matter lightly. Michael Fourte was ordered to cover the plaintiff’s legal fees, a financial penalty accompanied by a stern warning.

According to the court, the unverified use of AI-generated content in legal filings poses a threat to clients, the justice system, and the credibility of the legal profession. This case highlights the dangers of over-reliance on AI tools, particularly when used without rigorous oversight.

AI: A Double-Edged Sword

The Fourte case reignites the debate over the integration of AI technologies in the legal field. While these tools can lighten attorneys’ workloads by automating certain tasks, they require heightened vigilance. AI “hallucinations”—plausible but erroneous responses—can have serious consequences in a context where accuracy and authenticity are paramount.

This scandal may prompt judicial authorities to establish stricter guidelines for the use of AI in courtrooms. In the meantime, Michael Fourte must answer for his actions and rebuild the trust of a profession shaken by his choices.
